“Probate” is the court process by which an instrument is determined to be the last will and testament of the deceased, (or if there is no will, the proceeding in which the deceased heirs are judicially determined). In Florida, circuit courts have exclusive jurisdiction. If the deceased has only personal property below a certain value, no formal administration is necessary. Summary administration may apply if the estate is equal or less than $75,000.00 or the deceased has been dead for more than two years. Ancillary administration is appropriate if a non resident dies leaving assets in Florida.
